Terms of Service
The short version: Noteify is a player for music that artists publish under open licences. Use it honestly, don't capture or redistribute the streams, and your library is yours to keep or delete. We don't sell your data or run ads.
1. Acceptance of Terms
By using Noteify, the music player app operated by WhatIsYourLife LLC (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.
2. Description of the Service
Noteify is a music player for independent artists. It streams music from Audius, a third-party open catalogue where artists publish their work under the Open Music License or under terms of their own; Noteify hosts no audio. You can search and browse the catalogue, play it, and keep a library of saved tracks, playlists, followed artists, muted tracks and listening history tied to your account. The Service includes the shared song pages Noteify serves at noteify.whatisyourlife.com: a link shared from the app opens a page that plays that one song, and anyone with the link can open it without an account.
3. Eligibility
You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement.
4. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@whatisyourlife.com of any unauthorized use of your account.
5. Your Library and Data
Your saved tracks, playlists, followed artists, muted tracks, reports and listening history ("Your Content") are yours. We claim no ownership of Your Content, and we use it only to provide the Service to you, as the Privacy Policy describes.
Your Content is stored under your account in Google Firestore, and Firebase security rules keep it reachable only from your account. By using the Service, you grant us a limited, non-exclusive, royalty-free license to store and display Your Content solely as necessary to provide the Service to you.
6. Music, Licences and Rights Holders
The music in Noteify is published by its artists on the Audius catalogue under the Open Music License, or under terms the artist declares, and Noteify shows each track's copyright line and licence on the player, with the full notice behind Credits. Noteify does not own the music and grants you no rights in it beyond listening through the app. You agree not to record, capture, extract or redistribute the audio Noteify streams, other than as the app itself provides.
If you hold rights to a track and believe it should not be available in Noteify, email support@whatisyourlife.com with the track and your claim. We will review it and, where the claim stands, remove the track from Noteify. A track removed from the catalogue upstream stops being available in Noteify as well.
7. Usage Records
To operate the Service and to build the features that learn from listening, Noteify records what you play and how you use the app, as the Privacy Policy describes. The records are tied to your account's internal identifier and never to your email address or name.
8. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Upload or transmit malicious code, viruses, or harmful content
- Attempt to gain unauthorized access to the Service or other users' accounts
- Engage in any activity that disrupts or interferes with the Service
- Use the Service for any unlawful or fraudulent purpose
9. Payments
Noteify has no in-app purchases or subscriptions today. Any future pricing will be stated in the app and in these Terms before it applies.
10. Privacy
Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference.
11. Intellectual Property
The Noteify app, its design and its original content, excluding Your Content and the music, are and will remain the exclusive property of WhatIsYourLife LLC. The music belongs to its rights holders. Our trademarks and trade dress may not be used without our prior written consent.
12. Third-Party Services
The Service relies on Google (sign-in, database and cloud functions) and streams from Audius (the catalogue). Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the practices of any third-party service, or for the continued availability of any track.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WHATISYOURLIFE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
15. Termination
We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. You may stop using the Service and delete your account at any time from the account sheet in the app, or by contacting support@whatisyourlife.com.
16. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the Effective Date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to its conflict-of-law provisions. You and WhatIsYourLife LLC agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Tennessee, and you consent to the personal jurisdiction of those courts.
